If you do not agree with our policies and practices, do not download, register with, or use this Platform. By downloading, registering with, or using this Platform, you agree to this privacy policy. Your continued use of this Platform after we revise this policy means you accept those changes, so please check the policy periodically for updates.

The Platform is only intended for use by users located in the United States.

Children Under the Age of 16

The Platform is not intended for children under 16 years of age, and we do not knowingly collect personal information from children under 16. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. Information We Collect and How We Collect It

At Mulberry Tree, your data is a pivotal ingredient, allowing us to sculpt a platform meticulously crafted to suit your preferences.

We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked to a particular user ("personal information"). Personal information does not include publicly available information from government records, or deidentified or aggregated user information.

We collect personal information from and about users of our Platform:

Directly from you. For example, when you register for an account or verify your account.

Automatically when you use the Platform. For example, we may collect certain details of your access to and use of the Platform, including traffic data, location data (including precise geolocation data), logs, and other communication data and the resources that you access and use on or through the Platform, including mastered recipes, completed classes, duration of use, and interactions with existing and forthcoming features.

Information You Provide to Us

When you download, register with, or use this Platform, we may ask you to provide information:

You may also provide information for publication or display ("Posted") on public areas of the Platform or websites you access through the Platform (collectively, "User Contributions"). Your User Contributions are Posted and transmitted to others at your own risk. Additionally, we cannot control the actions of third parties with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

When you download, access, and use the Platform, it may use technology to automatically collect:

Usage Details. When you access and use the Platform, we may automatically collect certain details of your access to and use of the Platform, including traffic data, location data (including precise geolocation data), logs, and other communication data and the resources that you access and use on or through the Platform, including mastered recipes, completed classes, duration of use, and interactions with existing and forthcoming features.

Device Information. We may collect information about your mobile device and internet connection, including the device's unique device identifier, IP address, operating system, browser type, mobile network information, and the device's telephone number.

Stored Information and Files. The Platform also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, other applications present on your device, personal contacts, and address book information.

Location Information. This Platform collects precise geolocation information about the location of your device.

If you do not want us to collect this information either do not download or access the Platform, or delete it from your device. Note, however, that opting out of the Platform's collection of location information will disable its location-based features.

We also may use these technologies to collect information about your activities over time and across third-party websites, apps, or other online services (behavioral tracking). These technologies can help us tailor advertisements and content to your preferences, for example, to prevent vegetarian users from receiving meat-based advertisements. At this time, Mulberry Tree does not recognize "Do Not Track" signals provided by some browsers even if the "Do Not Track" signal is activated on your browser.

We may disclose anonymized or aggregated information about our users, and information that does not identify any individual or device, without restriction.

We do not sell your personal information for monetary consideration. We may, however, share disclose personal information that we collect or you provide:

Your Choices About Our Collection, Use, and Disclosure of Your Information

Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the Platform may then be inaccessible or not function properly.

Promotion by the Company. If you do not want us to use your email address to promote our own or third parties' products or services, you can opt-out by adjusting your communication settings in the Platform or unsubscribing from promotional messages through the link provided in our emails. Alternatively, if you face any difficulties unsubscribing, send us an email at Privacy@mulberrytree.io with the subject line "Unsubscribe" and we will process your request. Even if you unsubscribe from promotional emails, you will still receive service-related emails to notify you of, for example, account updates or changes to our Terms of Service.

We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.

Data Retention Policy

We retain your personal information only for the duration your account remains active. Upon your decision to terminate your account we will begin to delete your personal information. We may retain certain information due to legal obligations, or administrative or accounting purposes, as permitted by law. We may also retain information that has been anonymized for our own analytics or other business purposes. If you are a Content Creator or otherwise submit User Contributions, we retain our unlimited, free, worldwide right to forever use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any User Contribution for any purpose, even if or after you terminate your account.

Your Rights Regarding Your Information

At Mulberry Tree, we are all about respect in the kitchen---and that extends to your personal information.

We offer you specific rights regarding your personal information. Some states, including California, Colorado, Connecticut, Virginia and Utah, require these by law. This section describes your rights under this Policy and explains how to exercise those rights.

Right to Know.  You have the right to know whether the information we have collected, sold, shared, or disclosed for a business purpose your personal information. If you make this request, we will return to you (to the extent required by law):

A copy of your Personal Information and further details about its processing.

The purpose and lawful basis for collecting or selling your personal information.

The legitimate interests we have for processing your personal information.

The length of time we retain your personal information. The length of time we retain personal information depends on your relationship with us and the applicability of the legal obligations we are subject to in the United States.

Right to Deletion.  You are entitled to request the deletion of your personal data from our records. Upon receiving such a request, we will verify your identity and inquire if you wish for your information to be entirely erased or if you would rather be added to a do-not-contact list. Please note that your information that has been aggregated or deidentified will not be deleted.

Right to Opt-Out.  You have the right to instruct us not to sell or share your personal information for cross-context behavioral advertising purposes.

Right to Correct.  You have the right to correct inaccurate personal information. Once we receive a request, we will rectify the Personal Information (to the extent required by law) without undue delay.

Right to Data Portability.  You have the right to request the specific pieces of personal information that we have collected about you in a machine-readable format (the right to data portability).

Right to Limit Sensitive Personal Information.  You have the right to object to our use and disclosure of personal information, including sensitive personal information, if you feel the processing of your personal information is unlawful or there is a risk to your fundamental privacy rights, or limit our use and disclosure to specifically permitted purposes.

Right to File a Complaint.  If you have a complaint about our use of your personal information, please let us know by contacting us at Privacy@mulberrytree.io. While we would appreciate the opportunity to address your concern first, you also have the right to make a complaint at any time to the appropriate Data Protection Authority in your country of residents.

To exercise any of these rights, please send us an email to Privacy@mulberrytree.io with "Personal Information Privacy Request" in the subject line. Please specify the service you are inquiring about and provide your full name, address, and email so that we may verify your request.

We will take commercially reasonable measures to respond to your requests within forty-five (45) days. We will inform you if we need an extension.

Accessing and Correcting Your Personal Information

You can review and change your personal information by logging into the Platform and visiting your account profile page.

You may also send us an email at Privacy@mulberrytree.io to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the Platform, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other Platform users. Proper access and use of information provided on the Platform, including User Contributions, is governed by our Terms of Service.

Data Security

At Mulberry Tree, we believe in keeping our kitchen tidy and your data secure.

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure, encrypted servers behind firewalls.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Platform like message boards. The information you share in public areas may be viewed by any user of the Platform.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our Platform. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide. Changes to Our Privacy Policy

We may update our privacy policy from time to time. If we make material changes to how we treat our users' personal information, we will post the new privacy policy on this page and notify you by email to the email address specified in your account and an in-App alert the first time you use the App after we make the change.

The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address and/or phone number for you and for periodically visiting this privacy policy to check for any changes.

Your State Privacy Rights

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Platform that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
